Terms of service.

Acceptance of terms.

By using iammarketing.io, opting in to any of our resources, booking a call, or purchasing a product, you agree to these terms. If you don’t agree, don’t use the service. iam/marketing means Scale Up Marketing LLC, a Florida limited liability company.

What we offer.

• Free resources — guides, newsletter, webinar replays. Free, evergreen, take what’s useful.
• AI Operator — a self-paced course teaching the systems we use to run 11 brands.
• Strategy audits — a free 45-minute call where we open your numbers and tell you where the leaks are.
• Done-for-you operator services — paid engagements where we run the work. Scope, fee, and timeline are defined in a separate signed Statement of Work.

Payments and refunds.

// Digital products (AI Operator, courses, guides)

• Payment is processed by Stripe in USD. Prices on the site are the prices.
• 14-day satisfaction guarantee on AI Operator: if it’s not what you expected, email hello@iammarketing.io within 14 days of purchase for a full refund. After 14 days, sales are final.
• Free guides are free. No refund concept applies.

// Done-for-you services

• Service engagements are governed by the Statement of Work signed at kickoff. The SOW controls if it conflicts with anything here.
• Standard terms: monthly retainer billed in advance, 30-day notice to cancel, no refunds on completed work.
• Performance-based components (revenue share, CPA bonuses) are calculated and paid per the SOW.

What you commit to.

• Provide accurate information when booking calls or filling forms. We make decisions based on what you tell us.
• Don’t redistribute, resell, or repackage our paid content. Buy a seat, get a seat. Bringing your team in? Email us about a team license.
• If we’re running your accounts, you grant us the access we need and you respond to operational questions within 2 business days. Engagements stall when clients ghost.
• Don’t try to break the site. No scraping, no automated abuse, no exploiting bugs. Report security issues to hello@iammarketing.io and we’ll thank you.

Intellectual property.

Everything we publish — frameworks, copy, design, code, course material, scripts, swipe files — is owned by Scale Up Marketing LLC. When you buy a course or a guide, you get a personal, non-transferable license to use the material. You don’t get to white-label it, sell it, or claim it as your own.

Conversely: anything you bring to an engagement (your brand assets, your customer list, your historical data) stays yours. We use it to do the work and we hand it back when the engagement ends.

Results disclaimer.

Case studies on this site are real outcomes from real clients. They are not guarantees of what your business will do. Marketing results depend on offer, market, product, ad spend, operator quality, and a hundred other variables outside our control. We commit to doing the work to a professional standard. We don’t commit to a specific revenue number unless that’s spelled out in writing in your SOW.

Liability.

To the fullest extent allowed by law, our total liability under these terms — for any claim, in any form — is capped at the fees you’ve paid us in the previous 12 months. We’re not liable for indirect, incidental, or consequential damages: lost profits, lost opportunities, lost data. Use the service at your own discretion.

This cap doesn’t apply where the law forbids it (gross negligence, willful misconduct, fraud).

Indemnity.

If you violate these terms or use the service to break the law, you agree to defend us against any third-party claim arising from your conduct, and to cover associated costs (legal fees, settlements, judgments).

Termination.

You can stop using the service anytime. Cancel newsletter via the unsubscribe link. Cancel a paid course by emailing us — refund eligibility per the rules above. Cancel a service engagement per the SOW.

We can terminate access if you violate these terms, abuse the service, or engage in conduct that’s harmful to other users or to us. We’ll give notice when we can.

Governing law.

These terms are governed by the laws of the State of Florida, USA, without regard to conflict of laws principles. Any dispute that can’t be resolved by good-faith email gets handled in the state or federal courts of Miami-Dade County, Florida. You consent to that jurisdiction.

Changes to these terms.

We update these terms when our practices change. The “last updated” date at the top reflects the most recent edit. Continued use of the service after changes constitutes acceptance.
